Visit of the representatives of the Bulgarian and Czech DPAs
On 9-11 July 2007 the Inspector General for Personal Data Protection hosted in the Bureau the representatives of the Bulgarian and Czech Data Protection Authorities.
The meetings between the guests and the Inspector General for Personal Data Protection and the representatives of Bureau’s departments allowed to discuss issues related to current data protection problems, exchange experience and present the problems faced by DPAs.
At the meeting, the effectiveness of current inspection methods and the way of enforcement by the Polish DPA of the statutory obligations imposed on data controller within the framework of “post-control“ proceedings were evaluated. The inspection of data safeguards was also touched upon. The way of inspection, system print-outs as proof from the field of data processing and system’s functionality were also discussed in detail. The Bulgarian delegation presented the way of conducting inspections at the entities which notified the processing of sensitive data (in Bulgaria the inspection at the entity which notified data processing is obligatory and shall take place within 1-2 months since the date of notification to registration).
The talks focused also on the issues concerning technical and organisational conditions for the systems used to personal data processing. The Bulgarian and Czech delegations were interested in the division of safeguards’ quality into basic, enhanced and high level applied in Poland. The representatives of DPAs exchanged information on complaint handling procedures. Additionally, the Czech and Bulgarian DPAs presented their procedures of imposing fines as effective means of enforcement of data protection rights. Such a solution is not provided for in the Polish Act on Personal Data Protection.
The invited delegations gave interviews to Rzeczpospolita daily. Moreover, the Czech delegation participated in a debate on medical data processing at Gazeta Prawna daily.
