Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (Directive on electronic commerce).

This directive regulates rights and obligations of service providers and consumers of the information society services. Provision of services by means of the Internet shall be subject to the principle of transparency of the service provider and respect to consumers privacy. The directive stipulates special rules on consumer’s personal data protection. This protection, apart form the general rules, shall consist in processing of data exclusively (with some exceptions) on the basis of consumer’s consent. Data shall be limited to indispensable minimum necessary to perform the contract on provision of a service. Users shall have a right to use services anonymously or with a use of nickname. As regards data processing for marketing purposes in national legislation of Member States which had chosen opt-out model there shall be a possibility to enter one’s objection to so called objections list guaranteed. Service providers shall be obliged to make regular revisions of such lists and to respect the reservations submitted.
