How to register a data filing system

A data filing system shall be notified to registration on the form the specimen of which is presented in Appendix to the Regulation by the Minister of Internal Affairs and Administration of 11 December 2008 on specimen of a notification of a data filing system to registration by the Inspector General for Personal Data Protection (Journal of Laws No. 229, item 1536).

Pursuant to Art. 41 para. 1 of the Act on Personal Data Protection the notification, concerning the data filing system submitted to the registration, should contain the following:

  1. an application for entering the personal data filing system into the register of filing systems,,
  2. an indication of the subject running the filing system and the address of its seat or place of residence, including the identification number in the register of enterprises setting up in business, if applicable, and the legal grounds on which he/she is authorised to run the data filing system, and in case of the subject referred to in Article 31a, indication of this subject and the address of its seat or place of residence,
  3. the purpose of the processing of data,,
    3a.description of the categories of data subjects and the scope of the processed data,,
  4. information on the ways and means of data collection and disclosure,,
    4a.information on the recipients or categories of recipients to whom the data may be transferred,,
  5. the description of technical and organisational measures applied for the purposes referred to in Article 36 to 39,,
  6. information on the ways and means of fulfiling technical and organisational conditions specified in the provisions referred to in Article 39a,,
  7. information relating to a possible data transfer to a third country.

The notification shall include all the information referred to in Art. 41 para. 1 points 1-7 of the Act and be signed by data controller (e.g. natural person running one person business) or other person authorised to represent the applicant.

The notification can be made electronically with the use of secure electronic signature. It can be also made electronically without using electronic signature, and be later provided in paper form. The application allowing to submit a notification online is available on the website of the Inspector General for Personal Data Protection – in the “e-GIODO platform” system.

Since July 2006, the notification can by also sent by post or submitted at the Bureau of the Inspector General for Personal Data Protection (ul. Stawki 2, 00-193 Warsaw).
