Which data filing systems are subject to the notification obligation
Protection of Personal Data. The notification obligation concerns such ordered data sets which are classified as data filing systems within the meaning of Article 7 (1) of the Act on the Protection of Personal Data.
Exemptions from the obligation for notification of data filing systems are laid down in Article 43 (1) (1-11) of the Act on the Protection of Personal Data.
Thus, when an entity processes personal data in a data filing system as a controller, and none of the conditions set out in Article 43 (1) (1-11) of the Act are met, then it is obliged to notify such a data set to the Inspector General for Personal Data Protection for registration.
