Is this possible for the data subject to demand the erasure of personal data?

Article 7 paragraph 3 of the Act of August 29, 1997 on the Protection of Personal Data (unified text: Journal of Laws of 2002, No. 101, item 926 with amendments) states that data erasure shall mean destruction of personal data or such modification which would prevent determining the identity of the data subject. As a result of such action the data controller shall not be able to further process personal data in any way. The provisions of the Polish law do not constitute any specific regulations concerning the erasure of data.

According to the provisions of Article 32 paragraph 1 point 6 the data subject has a right of controlling the process of his/her data processing. The subject has a right to demand the data to be completed, updated, temporally or permanently suspended or erased in case they are not complete, outdated, untrue or collected with the violation of the Act, or they are no longer required for the purpose for which they have been collected.

If the data subject proves that personal data are not complete, are outdated or processed not for the purpose for which they have been collected or with the violation of the provisions of the Act, the controller on the grounds of Art. 35 shall be obliged without undue delay to amend, update or correct the data, or to suspend the processing, or erase the data, unless other acts of law state otherwise.

If the controller fails to erase the data, the data subject may apply to the Inspector General for Personal Data Protection with a request to issue a relevant order to the controller telling him to erase the personal data.
