What is the scope of personal data which can be demanded from the employee by the employer while concluding a contract?

The scope of the personal data which can be obtained by the employer from the employee or job applicant is presented in Article 221 of the Act of June 26, 1974 - Labour Code (unified text: Journal of Laws of 1998, No. 21, item 94 with later amendments). This provision came into force on January 1, 2004.

According to the provisions of the Labour Code, the employer has a right to demand from the person applying for a job the following information: date of birth, place of residence (address for delivery), education, professional career.

The scope of data which can be demanded from the employee is slightly wider. Article 22 paragraph 2 of the Labour Code states that the employer has a right to obtain such information as: names and dates of births of children if it is necessary because of the special rights used by the employee according to the provisions of the Labour Code, the number of the Universal Electronic Population Census System (PESEL number).

Furthermore, the employer has a right to obtain from the employee other personal data than those mentioned above if this obligation results from other provisions of law (paragraph 4 of the quoted provision). Making the data available is possible on the declaration of will of the data subject.

Such declaration of the person applying for a job can not be treated in the same way as the data subject's consent for the processing of personal data. In case of the employee, such consent is needless because the employer has a right to process personal data of the employee on the grounds of other provisions.
