Are the personal data of the people that passed away protected under the provisions of the Act on the Protection of Personal Data?

The Act on the Protection of Personal Data determines the principles of personal data protection of the natural persons whose data is or may be processed in the data filing system (Article 2 paragraph 1 of the Act).

The Act shall be applied only to the data of natural persons. According to the provisions in force a natural person is a human being who is the party to the legal relations. Legal capacity of being subject to rights and obligations ends at the moment of death. The deceased person can not be the subject to rights and obligations and can not take part in legal relations, and so cannot be regarded as a natural person.

The Act on the Protection of Personal Data by it self indicates among other prerequisites that allow personal data processing the consent of the data subject. It also mentions the rectification, access to personal data or the right to lodge a justifiable complaint, or even the right to object to the further processing of his/her data. These rights can be exercised only by a living person.

According to the above facts the Act on the Protection of Personal Data shall not be applied to the processing of personal data of the people who passed away. No one has a right to decline the demand for the information concerning deceased people under the provisions of the data protection Act.

In case of processing of personal data of the deceased (for instance for direct marketing purposes) the family of the deceased person has a right to turn for help to the court because of the breach of the personal rights of the deceased.
