Do publications in newspapers and books fall under the provisions of the Act on Personal Data Protection?

Publications in newspapers and books which include personal data in the disordered manner shall not be considered as personal data processing as a part of data filing system, therefore the provisions of the Act shall not apply. The Act on the Protection of Personal Data shall determine the principles of personal data processing as a part of data filing system. The existence of the filing system is irrelevant only in case when the personal data is processed in the computer system. Acquisition of personal data for publication purposes shall fall under the provisions of the Act, only if this data is acquired from the data filing system. In this case the provisions of the Act shall be carried out by the data controller.

The definition of the data filing system is of fundamental meaning. According to Article 7 point 1 of the Act the data filing system shall mean any structured set of personal data which are accessible pursuant to specific criteria, whether centralized, decentralized or dispersed on a functional basis. The accessibility refers to the specific personal data and not other information which can be used to obtain the access to the data. Publications in newspapers and books can include personal data but the main problem is the processing of personal data in the filing system. Beyond any doubt, according to the definition of Article 7 point 1 of the Act the publishing of names in the form of the lists, biography notes or encyclopaedia or dictionary entries shall be regarded as data processing in the filing system. The access criteria are specific and dispersed on a functional basis, in most cases in alphabetical order sometimes with some additional criteria (year of promotion or the theme).

Information published disorderly, that is for instance the names mentioned in press articles shall not be considered as the processing of personal data in the filing system therefore, this information is not subject to the provisions of the Act on Personal Data Protection.
