Recommendation R(87) 15 regulating the use of personal data in the police sector

(Adopted by the Committee of Ministers on 17 September 1987 at the 410th meeting of the Ministers' Deputies)
The recommendation applies to the automatic processing of data; however a member state may extend the principles contained in this Recommendation to personal data not undergoing automatic processing. The recommendation contains definitions of such terms as “personal data”, “for police purposes” and “responsible body”. Permanent automated files should be notified to the supervisory authority. Ad hoc files which have been set up at the time of particular inquiries should also be notified to the supervisory authority either in accordance with the conditions settled with the latter, taking account of the specific nature of these files, or in accordance with national legislation. The collection of personal data for police purposes should be limited to such as is necessary for the prevention of a real danger or the suppression of a specific criminal offence. Data based on facts should be distinguished from data based on opinions or personal assessments. The recommendation specifies the conditions on which data collected for police purposes may be communicated to other bodies, private parties or foreign entities. The recommendation also provides the right of access to the data and their rectification. The recommendation prescribes establishment of an independent supervisory authority outside the police sector, which should be responsible for supervision of personal data processing carried out by the Police. As regards the collection of data, the Police may only collect personal data of persons who meet specific criteria. The police are also obliged to inform citizens that they collect their data unless it threatens a conducted investigation. Files kept by the Police for administrative purposes (for example, information on firearms certificates granted, list of taxi drivers or foreigners) should be kept separately from files intended for fighting against crime. Interconnection of data files is allowed if it applies to the files concerning criminals. The recommendation allows for communication of data between different police units.
