Conventions

Convention No. 108 of January 28, 1981 for the Protection of Individuals with regard to Automatic Processing of Personal Data holds a fundamental position in the Council of Europe’s standards for personal data protection. Among the standards of treaties provisions of the Convention of November 4, 1950 for the Protection of Human Rights and Fundamental Freedoms (European Convention for Human Rights) with the latest Strasbourg judicial decisions with regard to medical data processing should be also taken into consideration. Provisions of the Convention of April 4, 1997 for the Protection of Human Rights and Dignity of the Human Being in the field pertaining to the protection of personal data with relevant fragments of its Explanatory Memorandum are important as well.

On January 19, 1993 Poland ratified European Convention for Human Rights, and on May 1, 1993 it acknowledged the powers of the European Commission and European Court of Human Rights with regard to examination of individual claims.

On April 21, 1999 Poland signed Convention No. 108 of the Council of Europe. The Convention was ratified by Poland on May 24, 2002.
